TERMS OF SERVICE

Krauss Fitness / Krauss Strength & Performance

Effective Date: March 3, 2026

Welcome to Krauss Fitness (“Company,” “we,” “us,” or “our”). By purchasing training services, accessing our programming, or using our digital platforms (including TrainHeroic), you agree to the following Terms of Service.

If you do not agree, do not use our services.

1. SERVICES PROVIDED

Krauss Fitness provides:

• In-person personal training
• Remote / virtual coaching
• App-based training programs
• Strength & performance programming
• Digital training guides
• Educational fitness content

All services are provided for general fitness and performance purposes only.

2. ASSUMPTION OF RISK

You understand that strength training, conditioning, mobility work, and physical exercise involve inherent risks including but not limited to:

• Muscle strain
• Joint injury
• Cardiovascular stress
• Serious bodily injury or death

By participating, you voluntarily assume all risks associated with exercise and training.

You confirm that:
• You are physically capable of participating
• You have consulted a physician if necessary
• You will inform Krauss Fitness of any injuries or medical conditions

3. MEDICAL DISCLAIMER

Krauss Fitness does not provide medical advice.

Nothing in our services should be interpreted as:
• Medical diagnosis
• Treatment
• Prescription
• Physical therapy
• Rehabilitation

Always consult your physician before beginning any fitness program.

4. RELEASE OF LIABILITY

To the fullest extent permitted by law, you release Krauss Fitness, its owner, affiliates, contractors, and representatives from any and all liability, claims, damages, or causes of action arising from participation in training services.

This includes negligence claims, except in cases of gross negligence or intentional misconduct.

5. PAYMENT TERMS

In-Person Training

Payment is due prior to or at the time of session.

Virtual / App-Based Training

Payment is due in advance on a monthly basis.

Failure to pay may result in:
• Immediate suspension of app access
• Removal from programming
• Termination of coaching services

Krauss Fitness reserves the right to adjust pricing on subscriptions with 30 day notice. Krauss Fitness reserves the right to adjust pricing on one-time services or new subscriptions without notice. 

6. CANCELLATION POLICY

In-Person Sessions:
• 24-hour notice required for cancellation
• Late cancellations may be charged in full

Virtual Coaching:
• Monthly subscriptions may be canceled with 7 days’ written notice prior to renewal
• No refunds for partially used months

7. NO GUARANTEE OF RESULTS

Individual results vary.

We do not guarantee:
• Specific strength gains
• Weight loss
• Body composition changes
• Athletic outcomes

Results depend on:
• Effort
• Consistency
• Nutrition
• Recovery
• Genetics

8. INTELLECTUAL PROPERTY

All programming, materials, guides, videos, and training systems are the exclusive property of Krauss Fitness.

You may not:
• Share login credentials
• Distribute programs
• Screenshot or reproduce content
• Resell programming
• Use programming for commercial coaching

Unauthorized use may result in termination and legal action.

9. DIGITAL ACCESS & ACCOUNT TERMINATION

Access to TrainHeroic or any app platform is licensed, not sold.

Krauss Fitness reserves the right to:
• Suspend access for non-payment
• Remove members for inappropriate conduct
• Modify or discontinue digital offerings

No refunds will be issued for termination due to violation of terms.

10. TRAVEL TRAINING

If Krauss Fitness travels to client locations:

• Client assumes responsibility for safe training environment
• Adequate space and equipment must be provided
• Unsafe conditions may result in session cancellation without refund

Travel fees may apply depending on location.

11. REFUND POLICY

All sales are final unless otherwise stated in writing.

No refunds on:
• Completed sessions
• Digital guides
• Monthly subscriptions already billed

Exceptions may be made at Company discretion.

12. CHARGEBACKS & PAYMENT DISPUTES

Clients agree not to initiate chargebacks without first contacting Krauss Fitness to resolve concerns.

Improper chargebacks may result in:
• Immediate termination
• Collections action
• Legal remedies

13. INDEMNIFICATION

You agree to indemnify and hold harmless Krauss Fitness from any claims resulting from:

• Your participation
• Your misuse of programming
• Your violation of these terms

14. PRIVACY

Personal information collected during intake or training will not be sold or shared, except as necessary to provide services (e.g., app platforms, payment processors).

15. GOVERNING LAW

These Terms are governed by the laws of the State of New York.

Any disputes shall be resolved in New York courts.

16. MODIFICATIONS

Krauss Fitness may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
